I was going so fast the other day that the wind blew my tinfoil hat off and when I reached down for it I swerved and did a 17g spin...Onstar called and asked if I needed new underwear... sadly I did and they gave me directions to the nearest Walmart Does that count?

Yes and they would have to prove it if you sued them. That line sounds like one added by a lawyer to cover their butts in the cases of law enforcement intervention. So the criminal can't sue OnStar for letting the FBI tap their OnStar, even though precident set in a recent court case basically doesn't allow them to do that anymore. As I said, still no definitive proof this ever happened. And if you read the rest of the T&C the system is built with notifications to advise you that you are being connected with OnStar.

I don't know. I left a nasty hot wing and beer fart in mine the other day and a moment later I heard someone coughing and hacking in the speakers. LOL

OnStar wouldn't dare try to spy on people (as if they had a reason to anyway), because as soon as they did someone would figure it out, blast it to the media, and OnStar would quickly cease to exist as a company.

About 45 minutes after I purchased my car. The passenger was talking to onstar trying to get my home address corrected. I accelerated to 130 FAST.... nothing was said. Thta proof enough for me.
