I've been looking for this in the VC for quite some time. But I can find nothing to suggest they can actually nail you for that. I can find VC 27 (Impersonation of Patrol Member): "Any person who without authority impersonates, or wears the badge of, a member of the California Highway Patrol with intention to deceive anyone is guilty of a misdemeanor"

VC 30 says that "emergency vehicles engaged in police, fire and lifesaving services" will use red flashing lights, I would also think that would put blue out of the picture as well. Plus my Camaro doesn't look like a Crown Vic. Plus the halos won't (yeah I know they can) be flashing. AND I would have to have the intention to deceive (note that VC 27 has "with intention to deceive" rather than "and/or attention to deceive").

Am I totally off my rocker on this one, or am I completely missing something?

Good job for sure.

I Alaska up until a year or so ago they were still writing tickets for DRL's that had any amber shwoing even though it was a Fedral directive that all newer cars have DRL's on anytime the car was in drive........it takes a little common sense as most LEO's have, but there are always bad apples anywhere.

Chase real crime and obvious violations saves all $ and bad feelings.

By the letter of the law, I cannot find anything as well that they could get you for. By the letter of the law.

However, keep in mind that law in this country is open to interpretation, and an officer is expected to use their best judgement. With so many laws it's very difficult for an officer to know everything, so they are not expected to by the court, which allows them to make judgement calls. This enables them to still cite you for impersonation, or a lesser charge, and you now have the burden of proving your innocence.

It always pays to be respectful to the officer you are dealing with for many reasons. However there is a saying in law enforcement - "You may beat the charge but you won't beat the ride".

Thank you, and for the funny part that is how it is spelled on his business card... so I just put it as it was. However, my wife kept picking on me for spelling Fremont wrong...

In Texas you'd be wrong.

Actually it is still the burden of the officer to prove your guilt. One is still innocent till proven guilty.

We have a DPS Officer in the club and he runs blue halos all the time. He was pulled over once for them and explained to the officer that they are not illegal in the state of Texas.

Correct the officer has to prove your guilt, but can cite you either way. You still have to jump through your own hoops in your defense however =)

BEAUTIFUL!!! SIMPLY MARVELOUS!!! What I did was just tell the judge straight out, I didn't change a thing with my side markers. He looked confused, at first, then sent me to a sheriff's office downstairs from the court. The OC Sheriff Deputy looked at the lights, and saw they were amber. Signed the ticket off, and I had to pay the court fees. They got $25 out of me somehow, though. Falundir...great job!!!

Chris....LOLOLOLOLOLOLOLOLOLOL I just got another ticket for red side markers here in Oceanside. Cap was a dick, and I was one right back to him. He wrote it as correctable, so I might just have my brother sign it off and be done with it, or I might go to court and be an asshole. He wrote it for CA Veh Code 25109, which is Running Lamps actually. LOLOLOLOLOLOLOLOL

I'd agree, if mine were "red". I'm just gonna use Chris' docs as my own and show how they meet the standard for "amber". LoL...stay tuned in case I need bail money. LoL
