If anything, if you get this repaired vs getting a new vehicle, I'd definitely tell whoever does the repairs to get those air bag sensors looked at. Is it still under warranty?

I'm pretty certain the point of impact on the Escape didn't warrant airbag deployment.

And people wonder why insurance premiums are so out of control. Anything happens and somebody is looking for a way to get some money that isnt theirs and didnt earn.

This country needs a lot less people trying to take someone else's money.

And if you are not injured, the car functioned CORRECTLY by NOT needlessly deploying the airbags. They only go off if necessary and the force is sufficient, obviously that was not the case. The speed you are going before the accident has nothing to do with the airbags deploying, it is the change in speed that sets them off. The airbag light is probably on because the wires got damaged, but the sensor never saw enough force to deploy.

I had a Mustang hit the retaining wall of a freeway at 65 MPH last year (ex-girlfriend pulled the wheel cause she wanted cigarettes), very similar damage and damage location with neither airbag deploying. My thoughts are the same as some posters before, the car did it's job by protecting both of us and not slamming us in the face with a punch like an airbag. Airbags can cause damage and it sounds like you would even want to sue if they deployed and hurt you... this is why this country needs tort reform. Loser pays. Would make you think twice about suing.

you cant sue someone for injuries if they dont exist. first rule of business law is your nose better be clean and and you better have a case. 2nd rule is you better have deep pockets.

my airbags didnt go off in my 2004 F-150 BUT I WASNT HURT. Is it possible that they are smart airbags? and maybe the computer didnt deploy them because it wasnt needed?

Airbags don't go off based on speed, they go off based on decleration. The pictures show you had a bumper under ride. The vehicle ahead of you slammed on the brakes causing the nose to dive and the rear end to come up. You then braked hard causing your nose to dive lower than the bumper of the vehicle in front of you. This causes a much softer crash. Not saying it isn't serious, but people generally misunderstand what the sensors detect in order for the airbags to fire.
