I agree with what Number 3 said....

My wife was in an accident years ago in a '97 Avenger....airbags didn't deploy and we asked about it. The service tech told us that if you are decelerating hard enough that the nose dives, the airbags probably will not deploy. The reasoning is that if the nose is diving that hard, the front seat passengers are likely pitched forward too. If that is the case, and the airbag deploys, the front seat passengers will likely have their heads snapped back so fast that a much more serious injury will occur.

So, basically, the programming keeps the bags from deploying so as not to snap front seat occupants necks. Then the manufacturers will get sued for really big dollars.


Edit: Sorry, I should have added....since this is by design and they did what they are supposed to do....you could sue Ford......................and lose, but I don't see any other outcome for you. Also, as has been stated, by your own account, you were following to closely. I would guess the only reason your vehicle wasn't ticketed was the corroborating statements of the first vehicle doing the "cutting off" and "sudden stopping for no apparent reason". If it went to court, Ford would have no problem proving that your vehicle was following too closely. Too many things working against you to win a lawsuit. Sorry.

If you're going to sue anyone, how about the "bumper bar/bush basher" manufacturer? Damn thing's too small and of little effect on the "off-road routes" you travel... What if a moose or a grizzly bear ran out in front of you??

I think a "kangaroo bar", like you see on Peterbilts 'n such made out of 4" tubing, would be MUCH more appropriate...and would teach those people NEVER to stop like that again...

Seek a lawyer for legal problems. And whatever you do, don't post your issues on the internet if you plan on legal action. Just my opinion.

The airbags should have deployed, IMO. You were going 60MPH and this looks to be a little more than a fender-bender. However, you should feel lucky you weren't hurt.

It doesn't look like a hard enough impact to have deployed the airbags. It looks like it was up high, and just crumpled the hood. The headlight on the passenger side isn't even broken. Also, there are sensors that detect how close you are sitting to the airbag. If you had the seat positioned too close, it may have purposely not deployed the bags to protect you.

Was the airbag light on before the crash or just after?

I'm glad everyone was OK. If you do sue, I would just like to thank you for helping to jack up all of our insurance rates, not to mention the sticker prices on future new cars.

Be careful about throwing around lawsuit threats. Based on the info you gave the wreck was your fault (since you rear-ended the guy in front of you.) If anyone has the right to sue in this situation, it would be the person you hit suing you.

You would only have a case after examining the car's computer and the airbag didn't deploy even after meeting all the criteria for deploying. Odds are the system was functional at the time and worked correctly.

No free money for you.

Jesus, what do you want, reparations? If nobody was hurt, the car worked exactly as it should. If you've ever felt an airbag to the face, you don't want that shit coming out unless it's absolutely necessary. I've had to spend a bunch of money reconstructing my nose because I got in an accident when I was 13 in a mercedes and it broke the hell out o my nose.

I'm not saying he should sue, but from the looks of the damages its apparent the airbags should have deployed. This wasn't your average fender-bender, considering the guy hit another car in the rear while going 60MPH.
