dont read into that too much you still have to prove that the person is about to or just had commited a forcible felony. you will still have to articulat that your or your family was in immediate danger of great bodily harm or death someone spraypainting your fence does not qualify unless he was also spraying the fence with a firearm

Granted...I will have to prove that I reasonably believed it was the only way to protect the property...but here in Texas homeowners typically have the benefit of the doubt.

I've had (in my town alone) instances where homeowners shot and killed (1) men attempting to break into their cars without a weapon at night with no legal recourse. (2) An actual incident where some punks kept tagging a fenceline over and over again and the homeowner pulled a shotgun on the guys in the act--only one got hit--but there was no legal recourse. Those guys didn't have guns on them either, just spray cans. (That's where I got the example for my statement in the first place). The individual committing the illegal act against me doesn't have to have a gun...nor does my life need to be threatened. I only have to show that they were committing an illegal act whereby my property was at risk...and it has to be at night.

But you're right that there is a possibility that the courts wouldn't side with me. It's kinda like the old guy Joe in Houston who shot two burglars trying to make away with his neighbors stuff, he shot and killed them both. Media shitstorm because of people saying he was racist...whatever. He didn't go to jail luckily either.

im moving to texas!!! here in IL you have to be shot, bleeding out, and the guy has to have had an uzi before you can leagally get away with shooting him. and the kicker is...........im a cop and these things all have to happen for me to shoot them.

Man there sure are alot of testosterone filled morons here. Most of you would of done what the OP did, stand amazed at the brazen behaviour of an idiot. Hopefully some of you will fully mature someday. Reminds me of a joke.... A cop pulls over a car for speeding. The driver starts smarting off and the cap smacks him across the face while the passenger sits and quietly watches, doing nothing. Then the cop procedes to walk around to the passenger and smacks him across the face. The passenger says "what was that for, I wasn't doing anything". The cops says, I did it because I know as soon as I walked off you would have said "I wish that mother f***er would of hit me, I would have kicked his ass".
It is a shame that there are people that don't respect others, but taking the high road and realizing you're the better person, not trying to retaliate is the proper way to handle the situation. Who knows, if you retaliate, you might end up being sued by the piece of trash and have to watch them drive by in your Camaro that he got in the settlement.

Something similar to that happened to me about ten years
ago I just finished a restoration job on a 67 Olds 442
buffed out the new paint job and drove it down to the
Jersey shore, parked in the lot about 400 feet from the
store no cars within 100 feet. I come out guess what?
theres a high top van parked with about 1 foot from me
I imediatly check the whole car out well there's a ding
that lines up to his door on my door.
Well I freaked out my wife started crying as I kicked and scratched
that custom van I know there were no scratches or dings I went from the shop to the store.
well that made me feel better even though I had to refinish the door

Yeaaaaaa. I guess you don't know me. Being a military vet--I've taken up some bad habits of letting people know when they are idiots, or when they're stupid, or when they've crossed the line. It has nothing to do with maturity, it has to do with being fed up with dirtbags and morons.

To be honest (because I know the law will protect that scumbag) I more than likely would have gotten the license plate and subsequently his address and made sure "karma" had his way with him. Because you're right that the law is ass backwards here and if I'd just smacked him for doing what he did he'll end up filing a civil suit for the injuries you inflicted upon him just because "he didn't notice where he flicked his cigarette".

Then again you can also go back with the cigarette and not attack him, but let him know that he fugged up...if he hits you first...so be it (there are ways around the civil suits you see because now you're having to defend yourself after returning a piece of his property!).

Good joke though!

Holy smokes. Geez, not excusing the perpetrtor, but, there are proper ways of handling something like this.

Obviously he was a bit jealous. Not excusing his actions. But, the reaction to be violent or cause more damage and risking personal exposure to charges is not a real good answer.

I would have done my best to follow, get his plate number and report the clown to the local authorities. Let the PD handle in a proper manner.

Like one of the other posters here said, you can't enjoy your Camaro from behind bars. What would be the point of that?
