Suggestions - What would C5OT do

Background,
Wife went to Subway and bought a chicken sub. While eating it she bit into a large bone and hurt her lower front tooth. She kept the bone, and recipet and contacted the Subway shop that sold her the sub as well as corporate.

We waited about a month for them to follow up to see a dentist of there choice but they did not call and during that time the tooth chipped. So, we contact corp again along with emailing them. Again, no response for 2 weeks. I called the corporate office to final a 3rd compliant and then got some movement.

Wife went to the dentist today and they filled it but stated it will not last and she should get a vernier. She does not have any issues with her teeth in the past and obviously upset about this. Cost to do this is 1108 dollars and no 100% guarantee that it will always match the rest of the teeth.

Subway is fully aware of the situation and will be evaluating the bone once they receive it.

Suggestions, should we ask for more money? If so, anyone have an idea how much?

I'd say contact a lawyer, sounds like Subway isn't going to own up to it. Once they see you mean business, I'm sure they'd want to avoid a lawsuit and try being more cooperative.

Lawyer up, and don't give Subway the bone. Once its gone, your proof is gone too. If they want to see it, they can have someone come visit you.

If it was more money I'd say get a lawyer. In this case ask for them to pay out general liability so at least you'll be reimbursed for the dental costs. I don't know how it is with food franchises but my experience running Loss Prevention for retailers is that we pay to reimburse if a customer has an accident in our store if we are at fault.

I would keep working the corporate ladder. If it was something bigger, I would say get a lawyer but the lawyer will end up costing you more then what it would cost to fix the tooth. Keep bugging them. If they see you are not going to go away hopefully they will pay you off just to shut you up, lol
