Unhappy Can anybody help me with this ticket? :(

I was on my way back to Penn State because I have summer classes. I was on Walker Twp and it was my first time driving there so I dont know the roads at all. I was "speeding" by going over the speed limit, but I was honestly going with the flow of traffic which consisted of a bunch of cars going the same speed in the left lane blah blah blah). I think I was picked off because I was the last in the line + I have a Camaro (a v6... ).

I even pulled over before he got to me because I knew he was coming for me. I literally just paid my insurance and I don't have any money to pay this ticket. I mean I have a job but there is no financial aid for summer classes to help me pay for the classes.

I asked him if he would help me in court or whatever if I plead not guilty and he said "well, this was all taped on a camera so..." so basically that is out the window.

If anybody has any advice on what to do (besides not going over the speed limit :/ ), or knows someone, or anything, my family and I would greatly appreciate it.

Were you caught by State or Local Police? If State they have Radar. If Local they have only Vascar, lines on road. How fast were you going over speed limit. I would suggest you go to court UNLESS you disrespected the officer. If you didn't show the highest respect you might be wasting your time.

There are others so search on web.

If you were caught using Vascar there is usually a gray area before they issue a ticket unless it's in a school zone, active or not. Do some research on web about Vascar and PA Supreme Court on rullings.

In PA it's You the Officer and Judge with no other people in court room. I hope you can talk to officer and it will be excussed by Judge or maybe changed to a lessor charge, no points. They have heard most all excusses.

I have been very fortunate by not loosing in court.

He was a state trooper and I am always respectful to cops. He said if I took it to court he would be there and it would not be lowered. And it was radar...

The ticket is yours and it's not going away, if the trooper told you "no" on helping you out don't fight it.
Call the district magistrate listed on the ticket, explain your financial situation and set up a payment plan, they do it all the time.

If you can make it, always go to court. The few tickets Ive gotten over the years always end the same. They consider tickets a revenue source and all they really care about is the money.

I go to court every time, I plead not guilty, and every time the judge drops the points if Ill pay the fine.....and as far as I can tell, if it doesn’t generate points, it doesn’t show up to the insurance company.

Might be different there, but I’ve done it in Colorado, Texas, Alabama, Florida and Georgia....and in every single case by going to court I got the points dropped.


Also the few times the cop didn’t show the judge gave me that offer or he would reschedule my appearance so the officer could make it....like I said, its all about the bones....

I tend to be willing to pay to play, if Im speeding and I get caught, Ill pay the fine, I just tend to disagree to getting points on top of that for just doing 5-10 or so over on the interstate, which is all I do.


(this is assuming you were only a few MPH over werent going 100+ in a thirty or some other such foolishness, if that were the case, you deserve everything coming to you )


Also, Ive never heard of them turning down a payment plan, my brother was on an $8 a month plan for his ticket at one time.

I don't know how NJ is, but in PA to go to court you must pay ticket to get a court date and if you win they send a check, to you, usually within 30 days. I would assume a payment plan is possible.

It only cost you gas and tolls to go to court. Do it! It is extremely important to, if nothing else, have points removed. This DOES affect insurance rates.

it was 10 over! thats all and I was crusin with 3 girls in front of me in suped up subarus! ha! anyway, I cant go to court cause he lowered it to just 10 over instead of 14 or 18...i forgot... anyway I posted this just in case anybody here was a trooper or something and could let me off...but if not then its on me I guess....sadly

What kind of jacked up rule is that? I thought it was a national constitutional right to have your day in court....when did the states get the ability to over rule the national laws? Did we lose the civil war after all?

Just an FYI he can and probably will raise that citation back up to the original offense if you go to court.
It's perfectly legal, he already gave you a break in his mind and he will NOT take it well if you plead not guilty and waste his time in court.

That as well is jacked up, you mean he will willingly admit he lied on a government document that he signed along with the defendent when he stated what the speed was he was charging him with? That would leave all kinds of wiggle room in my mind in court......

I hate the blackmail techniques law enforcement and the courts use to get what they want....and thats what it is, give us what I want or else it will be worse for you.....sounds like a mafia scheme to me......

Couple of things. That whole thing about raising it up is true, BUT it can only be done within 30 days. After that, it will stand as is. In court, after 30 days, it can only stay the same or go down.

One point you can argue is the fact that you were keeping up with the speed of traffic and that the trooper profiled you. Profiling is basically saying that he picked you out of every one else because of the way you looked or the car you were driving, pretty much anything along those lines. Like it was said before, it's all about the money. If you know of something else that you can offer a ticket for then go that route. For instance, I was in a similar situation, I brought up the profiling because I was keeping up with a mini-van. In lieu of a speeding ticket, I offered the fact that I had tinted windows. Which, in NJ, is not legal on the front windows. It couldn't be argued because everything was on camera, meaning that it was clear that the mini-van was the original offender and that I was, in fact keeping up.

i have tinted windows which is totallt illegal and I was right behind somebody. my gf knows a state trooper in pa so he is goin to try and help but I heard the cop that gave me the ticket is a prick so idk if I will get out of everything. If I dont get out of it that way, I think I am going to bring up the profiling thing because I was not the only one goin that speed for sure

Were you pulled over in NJ or PA? If in PA, tints are completely legal so you couldn't offer that up as a bargain. Whether he is a prick or not, doesn't really matter. Profiling may be your best bet because it does sound like it's what happened. A police officer can technically pull over who he chooses, but he pulled you over as the speeder knowingly that you were keeping up with the flow of traffic. If you were in PA, it could be argued that you were chosen because you were out of state, which is also profiling. How's your driving record over the past 3 years?
