Sorry - but speeding is NOT breaking the law
Clarify:
* in the US * as long as you don't harm anyone doing it (in other words, if you crash into someone or cause someone else harm in any way whilst speeding, then and only then have you broken the law). Source: (see parts 1, 2 and 3) According to US law, if a police cop simply pulls you over or waves you over because he caught you speeding with a radar/laser gun, you have not broken the law because the police cannot prove that he was personally harmed by your actions. See video for more details. I'm posting this because of the self-righteous replyers to another traffic ticket thread saying that the OP broke the law. Actually he didn't. Comments? (see video before commenting). |

I'm sorry to disagree, and I DO speed sometimes I admit. But what you are saying is, as long as the crime is not done it is illegal... yes maybe, but if you Speed, it's equivalent to pointing a gun at a Cop without firing. Technically, you did not "Kill" the cop, but the cop will take you down anyway. It's precaution to broken law, that's why it's so strict... so I'm not sure where you are going with this thread. The Speeding laws will never be lifted.

This video is full of crap. He is speaking as if this is civil case law. But speeding tickets aren't civil- they are criminal. It's an infraction (or misdemeanor) depending on severity. He has NO idea what he's talking about at all. The speed limit ordinances have been passed by the legislature so unless he can get the supreme court to hear a case where he says the state has no right to pass a speed limit law, then the speed limit is the law of the land.
This is the same mumbo jumbo that 'constitutionalists' use to declare themselves an independent country outside the jurisdiction of the US even though they are living in the Montana mountains, or the pot-growers use to say the US has no legal right to tell them that pot is illegal. (edit: I see a litigator posted above while I was typing this, I'd like to hear more details). |

Very simple, you break the posted speed limit by however much and you get pulled over, you are getting pulled over because you broke the LAW. Speeding is against the law. You didn't commit a horrible crime but it is still breaking the law. Please do speed and let us know how your defense goes.
