wow...that does hurt to see the car in such bad shape. I wish you had pics of the truck that crossed your path. Is anyone keeping a list of known totals?

The 25k limit wont apply there.
And in civil court the person waving him on could be held liable too.

civil court is way loser then crminal.

Also go after assets, not money if need be. Anyone can claim to have no money but cars, trucks, boats, tools, houses..... cannot be put in red on paper like money.

I really have to agree here especially the last bit. Don't sue for $XX,XXX cash unless you know the person has it, instead sue for $XX,XXX worth of assets. This is something I've learned from my dad a long time ago who's been working for the sheriffs dept and does nothing but court room work for the last 28 years. It's too hard to prove that someone has the cash to pay out unless they have a bank account which most people don't have but they almost always have something of value.

Also sue for "Punitive Damages". This money is tax free in the US and you can easily sue for $100,000 or more with this. Since your lawyer gets a percentage of this, they are a lot more likely to go the extra mile for you to win the case.

Sorry for the probs man. As you said our car was totaled in a similar fashion. Neither of us were hurt. I was impressed with the way the car reacted. We didn't hit the bumper though (full impact on core support). Glad you made it out ok and hopefully they total. Depends on state for what value has to be and insurance company to insurance company varies as well. Definitely fight over the diminished value. Our car had 25k in repairs and that totaled it out (parts alone was 17-18k). Talk to the body shop it's at and if they're cool they can help fight to get it totaled as well. You have the right to have any shop you please do the repairs (in TX anyway). Make sure it's the same where you're at.

William

Sorry to see an IOM brother down. Glad to see everyone is OK!! On a side note, does anyone think that all of these wrecks are going to cause our insurance to go up based on the wreck ratio?

Really sucks to see your car get damaged and it being someone else's fault.

I do however have to agree with what a few others have said - it is going to take a huge amount of damage to get your car totalled. Although obviously none of us would ever want our wrecked cars repaired, the insurance companies look at it purely as a financial decision.

Most states require 75-80% of damage to consider the vehicle totalled. In most cases where it is borderline they will sway in your favor as body shops often find things once they get the car apart. Given that your car should still have a retail value of $34,000.00 give or take a little your car would need at a minimum of $25,500.00 in damage. That is going to be a tough one given that your car did collapse exactly like it was supposed to and all that should prove to be much less expensive in repair. In your favor is the blown bags as they are extremely expensive and I like the way your state treats your mods - by considering them personal property.

Best of luck in dealing with this fiasco - so many of these Camaros getting wrecked each and everyday.

First, sorry for your accident. Major bummer. Second, somewhat of a reckless statement to say the car itself is dangerous. Accidents, roads, careless drivers are dangerous. The Camaro earned 5 star side and 4 star frontal ratings, and you walked away without serious injury (assuming). Best wishes on replacing/repairing the auto. Thank God no one was seriously hurt.

Peace
