It's too hard to prove that someone has the cash to pay out unless they have a bank account which most people don't have but they almost always have something of value.

Also sue for "Punitive Damages". This money is tax free in the US and you can easily sue for $100,000 or more with this. Since your lawyer gets a percentage of this, they are a lot more likely to go the extra mile for you to win the case.

I learned that after a good friend got their car messed up buy this little old lady who couldn't pay as on paper she was broke.

But she owned the #1 bar in town and the towns 7-11 with a gas station, both being the only one in town, and a few houses but she could never pay the money owed.

Insurance does suck

1) I'm sorry to see your baby is wrecked.
2) I'm glad the car behaved the way it was designed to and you are ok.
3) Yes. Our insurance rates are going to climb as some members have already noted, but not for reasons you all think. On a percentage basis I doubt there are more Camaros wrecking daily than say, all the Malibus. The difference is we are all passionate about our cars and we all want them totaled. We threaten to get a lawyer, sue for diminished value, scream at dealers for pre-delivery paint repairs (sub-par or not), etc. They are cars. Insurance companies will charge more for owners being a pita. I get it and don't want to have an accident and have to repair my car anymore than anyone else but you people do realize there are qualified shops out there with techs and equipment to repair cars to like new condition, right? Pick the right shop and you truly should have no worries. All the damage is cut off and replaced with new parts on a lasered bench if it's done right.

Best of luck to you, either way!

I wouldn't quite call the car dangerous. When a hyundai sonata hit my truck years back, this is the damage that happened to the car... My truck fared much better. Truck vs. Car. Truck always wins. Kinetic energy is great...

HAHA! Kia got jacked for sure. I think these cars do pretty well. Partly due to all that "m" in the kinematic equation!

He was attempting to cross a main highway with someone waving him that it was clear. Well the roadway wasn't!!!! I was traveling about 30 mph and look at the damage. These cars are dangerous. I took a hard hit with all the airbags out. I am now in a fight with insurance company's he has the great min in GA $25,000 coverage. I on the other hand have a underinsured policy that is suppose to pickup the difference. Fine and dandy but we found damage to the aftermarket turbo and associated piping.

So now my company wants to back track. (progressive is walking a fine line on this one) First they totaled the car but was trying to assess a value. Now they have moved to having the body shop completely strip the front end of the car off and they will do a complete estimate of the repair. They also stated they are having the engine completely checked out by GM. (plastic pieces of the headlamp was sucked into the engine through the turbo) I have stated numerous times I do not want the car fixed but they are not listening to what I say.

If they do end up fixing your car, make sure to mention that you want an "inherent diminished value".

That heppended to me, a ways back.. some idiot plowed into the back of my old car, and wrecked it pretty good. Their insurance was going to repair the car... but when I mentioned that I wanted to be compensated for this as well, they decided to total the car out. I guess they figured this would be cheaper.

good luck to you.

I'd say it took the hit pretty well. Crumpled in all the right places, didn't appear to pass along the impact to body panels to the rear.

WTF?!
I wouldve balled if that was me. Im glad your ok, but it really doesnt seem like a ride off, but im not an expert so take it with a grain of salt.
im soo sorry to hear about it. Im just happy your not in jail. Honestly, i think the fact that knowing how you customized the car just makes it 10x worse. The good thing is that your ok, lives cant be replaced, but cars can as much as it sucks. I hope everything gets straightened out for you and please update us as you go along
