Not in Texas..
thank god for that.
someone comes after you with a hammer or any other weapon and I can draw, warn, and fire on you if you don't heed my warning.

there is a reason the NRA has it's national convention here.
don't come to Texas looking to start something you will get shot.

you shoot and kill someone or seriously wound, they're going to put you in cuffs and take you to jail. they aren't going to pat you on the back and discuss technique with you. they may not ultimately charge you, but they're going to take you in for questioning, and probably hold you till the DA sorts it all out and decides what they're going to do. they can't just let you walk away after you've shot someone.

Texas or anywhere else.

All you would have to say if you would have shot him fatally or not.^^^

This is why we have the Castle Doctrine, is it not. To protect yourself or others at home or away.

I hope when I grow up (only 46 now) I can be this tough. Well better call the wife and let her know that we are moving to Texas......all the cool kids are doing it!

the idea that someone like this may indeed be running around with a gun almost makes me rethink my position on gun control.

I hope you don't seriously think a call to the police would be a valid option in a rapidly developing situation.

Given that somebody is already approaching you with weapon in hand, you do not have the luxury of waiting for a 911 operator to take your call, never mind wait for police response - no matter how close the nearest cruiser might happen to be. Nor do you have time to debate what his intent might be.

You have less time to react than it's taken you to read the previous paragraph, and you've got exactly one chance to get it right.

I was in a generally similar situation many years ago - a length of chain rather than a hammer being the assailant's weapon of opportunity - and it really does come down to "flight or fight".

Actually thats not true. They will take you in and question you but unless charges are filed, they can't hold you for more then a few days at most. If you claim self defense and the evidence proves self defense, you will be on your way in no time.

OP that is quite scary! I would've done the same thing but also called the cops and told them there's a crazy guy with a hammer in the streets. What if you heard later on that this guy killed someone and you could've prevented it with a simple 911 call? As far as shooting this person, shooting someone should be a final attempt to get away. OP did the right thing by speeding off. I'm all for gun rights, my house is well protected with them but they will only be used as a last resort.

i dont think the guys that are talking about shooting him would just shoot without cause or reason, the point is that if you have your chl and are presented with this situation (where you dont know if the guy will just hit the car or come after you) you can protect yourself...you warn the guy and give him the opportunity to stop or walk away. if he doesnt and continues to come after you after you warn him, and if he swings that hammer hard enough it's coming through the driver window into your face...and i'd rather that not happen...not all gun enthusiast are crazy shoot em up people...we can make smart decisions...but if someone comes towards me with negative or harmful intent, my ccw will definately be my first line of defense to keep him/her at bay until authorities arrive...

It's on the cusp...it's on the cusp of getting locked. Keep it going guys! You should all know that when you're presented with imminent danger, your first order of business always lies within asking the perp to stop attacking you with a weapon for 2 minutes while you call the police for help. I'm sure they'll oblige with your request. As for the person that suggested 90% of homeless folks are legally insane, here you go. http://www.nationalhomeless.org/fact...al_Illness.pdf Now, cite your source.
