OP did the right thing by leaving because he did have an avenue of escape and then notified the authorities. Everything else that has be added and discussed is either totally speculative or making assumptions that may or may not be true (and no one has any way to validate these statements). IF the open had a gun in his possessin legally MAYBE the situation would have resolved itself before anything bad had happened and maybe it wouldn't. Personally I have a CCW with a laser sight. I never practice with the laser sight...it's there for initimidation. It's the same reason I have a pump action shotgun at home for protection. EVERYONE knows what this sounds like and I'd much rather clean up sh!t in my foyer from a bad person running away than cleaning up blood and having to defend my position to police on why I shot someone. I hope I never have to shoot anyone...but if forced to I am willing to do it. That being said, I have just one more comment to make.....IBTL.

It's great that there are so many experts here that know exactly what to do at that exact moment. When in reality almost no one knows exactly how they might react in such a situation. It's equally awesome to see perfect strangers cast aspersions on each other for voicing an opinion.

Unbelievable.

My take, I don't think anyone is saying go Dirty Harry on anyone over a car. I don't discount human life, and I didn't see anyone else in this thread suggest that they did not value a life. I did read a few posts from a few people who belittled other forum members for suggesting that they might have decided to defend themselves though. Look, not every person who owns a firearm, that feels ok defending themselves, is a cowboy. Furthermore, I feel there are a few apologies in order. Having said all that, anyone who then deems a hammer weilding man as not a threat, that openly threatens you that might be mentally unstable, is not a sane or rational person.

I can only hope I am never in such a situation where I have to make a judgement call like that. If I am, it would probably haunt me to the end of my days. However, in my opinion you do have an obligation to your fellow peaceful human beings that are capable of living peacefully with the rest of society without posing a threat to either yourself, or your property. There are evil people in the world. Many of which are very capable of inflicting grevious harm to not only yourself and your property, but to the people you love.

That man is a timebomb, one that's probably going to go off at somepoint. I'm sorry he's had a hard life, I'm sorry he might be mentally incapacitated. I'm not sorry enough that I'd be willing to look someone's mom in the eye and explain that her child had to die because I felt sorry for homeless man with a hammer.

Sad state of affairs this 'America' is in. Home of the brave my ass.

Right. To use the 'fear for my life' excuse when someone is going to hit your car with a hammer will never fly in court. So the guy hits your car, he's not going to disable it with one swing from a hammer. You floor it and get away. Your life isn't in danger and your car can be repaired.

Texas or anywhere else.
******* Martin's 'murderer' is still in prison for 'fearing for his life' and 'defending' himself. How are you going to keep paying for all your toys when you're locked up for more than a year for being a hero?

And he wouldn't be in jail if the media didnt blow it up the way they did. Potraying Martin as a child when he definately was not. Sadly Zimmerman behind bars in fear of his life because the media made a good case against him without any evidence. When the evidence came out, did ya notice no more media attention? Because they know they were wrong but the damage was done. This country is full of sheeps that believe exactly what they are told. Wonder why the majority turns a blind eye while the govt tromps over our rights

off my soap box now

I think the op was fortunate that there was no traffic blocking him from getting himself out of danger, if he was not able to he has every right to defend himself, his passengers, and his property. You can legally carry a gun in your car in Texas without a CCW and use it if you are being threatened you would have to look up the law for exclusions. I would have no problem using it as a last resort.

Yes, there are some situations in which violence begets violence. There are certain situations in which lethal force is your only option and that I get and that use of force I can support. BUT, and this is a rather large but here, It's a hammer and a car. OP was IN the car.. The car was running. The myriad of other options that do not include ending another human beings life surely must come to mind.

No one was saying he should have called the police while he sat there and waited to see what the guy was going to do, just remove yourself from the situation and then alert the authorities as to the situation in hopes of helping someone else.

I do truly hope that the majority of these posts honestly are just interwebz tough guy talk and not peoples actual thought process. I LOVE my car.. LOVE IT!! But I would never end someone’s life for vandalizing it. Regardless of how angry I was. It's a life, people!

The OP did the right thing in leaving the situation. Perhaps he should have called the police following the incident, but the fact that the majority of posts are all perpetuating escalating the situation to ending the life of another human being is both mildly scary and quite disheartening.
I used to let these threads bug me....Now, it's no big deal....There's been threads where an OP has been advised he should have taken somebody's life for causing a door-ding to his car in a parking lot....

If half the posts suggesting someone like this homeless guy should have been shot and killed were even close to being actually done, the streets would be littered with bodies nation-wide on a weekly basis...

It's those that carry, and "just can't wait" for the opportunity to carry out some Rambo fantasy are the ones that give guns a bad name, imo...
And it's sad to see some so pre-occupied for so much of the time, just looking for such a chance....Whatever... it's basically all immature bs...

There are concealed carry clubs and organizations like the USCCA that have that sort of legal issue included with a paid membership.

Shoot him and hire a lawyer, if you lose in court, shoot your lawyer. Maybe the guy is a war vet all fu#ked up from what he's seen and been through, or he just doesn't like Camaros.
