The OP was minding his own business. Some waste of life comes at him with a Hammer.
I wouldn't shed a tear if extreme action was taken and the hammer wielder was killed.

If you act outside the law, why should you have the laws protection?

We should not value the life of a deranged harmful individual the same as that of an upstanding productive member of society either. Darwin was supposed to sort this out but now society is filling with burdens on society.

I don't carry, would have done the same as the OP did. Got out of there and called the cops. Would not of shot him had I been carrying as the option to flee was there. Still if someone did, he should not spend one minute in jail.

It's amazing how many of you are advocating shooting someone in this situation. Drive away or kill someone because they are walking toward you with a hammer -- hmmm, I wonder which one is the right decision.

What if you had a vehicle behind you, in front of you and had no avenue of escape? What would you do then?

Be a victim?

And a hammer IS considered a dangerous weapon that can cause fatal injuries

But I still marvel at Texas law on defending property with deadly force:

9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is
justified in using deadly force against another to protect land or
tangible, movable property:
(1) if he would be justified in using force against the
other under Section 9.41; and
(2) when and to the degree he reasonably believes the
deadly force is immediately necessary:
(A) to prevent the other's imminent commission of
arson, burglary, robbery, aggravated robbery, theft during the
nighttime, or criminal mischief during the nighttime; or
(B) to prevent the other who is fleeing
immediately after committing burglary, robbery, aggravated
robbery, or theft during the nighttime from escaping with the
property; and
(3) he reasonably believes that:
(A) the land or property cannot be protected or
recovered by any other means; or
(B) the use of force other than deadly force to
protect or recover the land or property would expose the actor or
another to a substantial risk of death or serious bodily injury.

The law sounds right to me, i wish Oklahoma had this law

First victim of what? A guy smacking up your car? Firearms aren't for shooting everything in sight you don't like, and the purpose of a concealed carry weapon isn't to prevent dents in your Camaro

In the USA today there's a lot of talk about guns. It's time the USA starts understanding what its talking about. And in TX, if the guy had been shot him for what happened...ask a TX cop what he thinks

We're not talking about anti-gun, we're talking about macho "I'd have killed the guy" bullshit.
