Dealership Entrepreneur Manual:

If you own a dealership (or any other business) you should follow these instructions.

1. Take ALL keys home with you every night and put them under your pillow in a secure case. Handcuff the case to yourself while in transit.
2. Hire as FEW people as you absolutely need.
3. If you are sick or have to go out of town, close your dealership while you are gone so that you can keep all keys with you in the secured case.
4. YOU and YOU alone should move, drive, or test any vehicle OR be there when any employee has ANY customers keys to be sure a copy or mold is not made.
5. Do NOT allow any employee to accept keys from a customer. YOU should be the one to handle keys at any time.
6. At the beginning and end of each day you must have a security checkpoint and frisk and inspect all employees who leave the property. Including going through bags, purses, pockets etc........... YOU can be the only person to do the inspections.
7. Do NOT allow any employee to be on the premises after you leave or before you arrive. Have them park outside or inside so that ehy can not come or go until you get there to inspect them.
8. Hire a security guard ............. wait..... nvmd ..... you'll be liable for them too.
8. Sleep at the dealership in shifts with your wife or a business partner. Keep all keys at your business partners house under his pillow while it's your shift to be at the dealership.
9. Put all customer vehicles in one large garage and pull your night shifts in that garage.
10. Install a finger print and/or eye retina scanner only set for YOU and your business partner to open all doors. Make sure there are NO keys to the facility. If you can not afford the high tech stuff, carry an extra case of keys for the facility.
11. Drug test, credit check, criminal background check, profile and portfolio check all empoyees and lay off any who do not meet stringent criteria.
12. Do NOT hire ex-cons, anyone with a credit score under 680, anyone with excess tickets or fines and other violations, any divorcees, any non-custodial parents, anyone who was ever fired from a job (or laid off because they may have had it downgraded), anyone who has had more than one employer per 3 years in the past 12 years or anyone who is not well groomed at all times........... you get the point.

This should keep you from EXTRA liability in case of after hours theft or damage from an employee of a customers car.

That, or take a class in Risk Management 101 and ignore PQ's rant.

B. The owner (OP) insurance company handles the claim and ensuing lawsuit against the thief who broke into the dealership and stole the car.

C. The dealership has no responsibility to rectify anything for the ZL1 damage.

D. The OP insurance company has the responsibility to make the OP whole as best they can and NOT the dealership.

HOWEVER!!!!!

Since the theft...and this IS a theft, the dealership is 100% responsible for all damage and to make the OP whole by any and all means up to and including breech of contract and merchant ability.

My house burns down accidentally, my house gets rebuilt better than it was before if that is how I want it. HOWEVER, if I contract someone to burn my house down, he gets caught, I get implicated, I am ass-out.

Catch my drift?
Nope , you would end up in a big place for a long period of time ( aka) jail .

The employee "DIDN'T" break into the dealership. He was given access. Without the access the crime wouldn't have happened in the first place. He didn't pick a lock or break a window. THAT is the point where the dealer needs to accept the responsibility. Taking the car off lot wasn't approved as they mention over and over again but the access to commit the crime WAS approved.

So if someone goes to my Bank , takes all or part of my money , in the process of doing it he /she doesn't need to dMage anything in order to get in and out , my money is gone and no one is responsible for it , that's my loss right

I left my money in there and they have the fiduciary responsibility to keep it in a safe environment of any kind .
^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^

Do I expect the dealer to "give" him a new 2014 ZL1? No, but their current offer is a joke. To make it right, they need to give the OP equivalent or better than what he had. IF that means a 14 ZL1, so be it. But the only opinion that matters is the OPs. I for one would expect more than the current offer as well. The current offer shows that the dealer isn't accepting responsibility of their ex-employee's actions as a representative of their dealership WITH ACCESS to commit the crime in the first place.
It shouldn't mater if it's an employee , or a complete stranger , the dealer has to keep other people propriety safe , that's all there is to it .

Don't do like the Postoffice ,,,,,,cut delivery days to save more money , better close even more days, to save even more money .

Ok I kept seeing you talk about how a business owner should do this and how they are not responsible for that. We do have the responsibility for so much and thats why we are insured and bonded. It is also why when an employee complains about how they don't make enough money and as a business owner we make so much profit (which really is not that much) off of their work I don't feel bad. We assume all the risk and "responsibility".

Much of the rule you put done as a joke I would follow.

I am not in 'defense' of the dealer at all. Very much in defense of the OP. But I doubt this dealer is as villainous as it's being made out. Stupid? Maybe...... Evil? Uh... no.

And again, I don't think anyone has said the dealer has ZERO liability in this. Only that their liability should be for the value of the car. After that it's only good business to go above and beyond to make the OP happy.

I wonder if this dealership is any kin to Savini Wheel Company?
You might be right on that last one , again .

New member to this Forum. I have read this thread start to finish. I owned a 1965 & 1970 GTO. When GM shot down Pontiac in favor of Buick, I lost faith with their treatment of loyal customers. I have been waiting for 3 years to get my hands on the ZL1 Camaro Convertible of my dreams. I didn't care how much it cost, I just wanted it to be perfect and stay that way. Because of this story and GM's lack of effort to do something I will find a different car. Maybe a Challenger if I can find a good dealer in Tampa, Florida.
