If I had a friend that I had met when we were freshmen in college, and if I knew that guy for 16 to 17 years. And if I had been over to that guy's house to have dinner with his family, and he and his family had been to my house for dinner. And if that friend were a cop. Look, I was feeling frisky one day and tore out of a red light right in front of a sheriff's deputy. He pulled over and waited on me. I pulled up next to him. He checked my license and turned me loose. But what would I have really said if he had written me a ticket. Absolutely nothing except "my bad." Not his bad, I was the one being a dumbass.

so far in every State that has a hands free law, Police and Fire are EXCLUDED specifically in the law.

The justification is because their phones are used to transmit information that they don't want transmitted on the open airwaves of their radios.

and the job of a LEO is to enforce the laws, PERIOD.. minor or major is not relevant. They see a law being broken they enforce it, they can usually use discretion and decide whether or not to be an ass about it, but they are merely doing their job.

I believe that 95% of LEOs are out to simply do their jobs, but there is a small percentage that want to be asses and a small percent that power trip and think they are above the law, and it is those LEOs that screw up the overall view the general public has of all LEOs.

What's a fast lane? No such thing.. In any State.. In all States the posted limit applies to all lanes.. all the time.. No lane gets to legally go faster than any other lane. PERIOD.


now if you are referring to the far left lane being a passing lane.. well ok, but only one state has a designated passing lane, the other 49 do not, this isn't Europe.

several states have enacted laws requiring people moving slower than the flow of traffic to stay to the right:

Illinois
Kansas
Kentucky
Louisiana
Maine
Massachusetts
New Jersey
Oklahoma

All of these States have very specific laws that say you must stay right if you are travelling slower than the flow of traffic, but NONE of those States give anyone the right to travel FASTER than the posted limit in the left lane or any lane for that matter, and none of them specifically call out the left lane as a passing lane.


However Colorado.. This State passed a law in 2010 I believe that calls out the left lane as a "passing only" lane if the posted limit is 65 or higher.

However, it still does not give you permission to break the speed limit, only to pass to go around someone moving slower than you, and NO ONE, can stay in the left lane other than to pass.. and it's a $500 ticket if you do.


The term "fast lane" is a very misunderstood nomenclature, that actually got it's start meaning that the far left lane tends to move faster than the rest of the lanes because it is not an exit lane, and you can't merge into it. It has NEVER had anything to do with being able to travel faster than the posted limit.

You're absolutely right, I use my phone at work to coordinate warrant services and meet-up locations. However, I can't speak for all law enforcement officers when I say that if its not work related I pull over or wait until I get a free chance to park and return the call. I do use a Bluetooth and that frees me up to continue patrolling for the most part but texting still causes me to have to stop. As for the guys that have a power trip and feel they are above the law, they tend to not last long on the department. Complaints and the one guy that decides to test the man behind the badge usually kill their careers. We try and weed out the guys that got bullied in school and try and get the job so they can return the favor. Departments don't have time for that garbage.

nothing but for most LEOs, I've run into a few that are asshats.. It is what it is, I simply allow them to do their jobs, and move on.

the place to get pissed and argue about the law is not with a LEO, they simply enforce, the place to argue statute is in the court.
