Defamation of character is one of the hardest things to prove in court. There has to be a proof of malicious intent not just opinion. I'm sure GM knows nothing about this, and the dealer is just blowing wind.....

I'm sorry, I agree we can't hold all dealers accountable for one knucklehead...

But this is why I typically default to all dealers suck. They have to prove me wrong. Unfortunately for me, in the Jacksonville area most Chevy dealers aren't very reputable...

Defamation of Character.... I'm not sure that even applies to a business, I think that is limited to person to person...

Just trying to use scare tactics. They're trying to use the fact that they're a dealership and have ties with GM and will "sue" you as leverage to get you to remove the post. Which, is a failure. Now they have made themselves look even worse.

Going to law 101 here- the dealership would likely be a 'limited public figure' in that it advertises goods and services in the media. As long as any statement KJS writes only refers to the business activities the dealership is supposed to perform (i.e.- he doesn't make statements that they are all adulterers or baby-killers or something) then there likely is no case at all.

And a 'legal letter' is meaningless. Assuming this is true as posted, a threat of a 'legal letter' means you are being threatened to be threatened.

Wow! Has anyone considered that KJS may have been guilty of being a loudmouth in the service department? When all is said and done, he will get thrown out of ANY business by making a huge scene. For some reason, people think they have the right to scream and shout at the top of their lungs in the middle of a business if they have a different view of how things should be. If KJS bought his car there, he has a little more clout than someone who bought elsewhere. If her didn't buy it there, I can guarantee you he will NEVER get his car serviced there from now on.

Being a customer doesn't give you the right to be a loudmouth.

Again, we are only hearing only one side of the story.

Wow, I just read that thread. He sounds like one of those high pressure stereo shops who gets mad at you when you don't buy something.

Based on that alone, I would for sure find another dealer. If anyone at a dealer ever raised his voice with me, especially when I caught them in a lie, they would lose my business for life.

And if those douchecanoes want to sue me too, they can pm me for my address. Bring it on biotches.

I called GM to register a complaint and waiting to hear back from them. Will keep you posted.

I'm sure if you put something in writing about that dealership that is not true or defamatory in nature, you will certainly get an e-mail or letter from them as well.

Why not publish it here and see what happens?

why are you making the assumption that it is not true or defamatory in nature? from everything i've read on both threads, it sounds pretty true and non-defamatory to me. i think it's pretty clear he was sent the nastygram as a scare tactic in order to pressure him to shut up.
