No Cop bashing from me, too many friends who are and are on the up and up.
If he pulled you over and used his lights, it is likely if he had a dash cam and all was recorded. There has been incidents here for those who think they are above the law, had their own dash cams used to prove they were in the wrong. That is another reason for installing dash cams in the cruisers, to protect everyone involved in situations. You could subpoena his dash cam to court if he keeps it up and it is ignored by his superiors. Good luck and stay clean. |

Was stopped once for crowding the yellow line, he met me on the highway. No ticket, but was a royal ass clown. Also was sitting at the truck stop talking with some buddies and he came in and told us we had to disperse or he would write us up for loitering...pretty sure I didn't see any no loitering signs, and truckers sleep there over night in their trucks, but whatever we just left and went to a diff location. Will add my sound recorder on my cell phone to my shortcut menu, and if it happens again I'll be going to the station......thanks for all the advise everyone!!

I would ensure that you always have something to record any stops by this guy on you and I would also file something with the department about your concerns. All about a paper trail. All one has to do is inform the other person they are being recorded and then (in Oregon at least) there is no illegality. My guess is that once this officer knew he was going to be recorded he would avoid you like the plague. If he's dumb enough to be an ass then he deserves to get hammered. |

I trust and respect police officers, but I have also experienced first hand where an officer lied to protect himself as well. Most police officers are great...but as I said earlier, they are human and there are going to be a few bad apples out there as well. edit: Another thought on this. Also, once they know you're recording, their behavior will change. This, however, doesn't deal with the problem that perhaps that officer might have been acting inappropriately to begin with....and might do so again to someone else later on down the line...someone who might not record the incident. To me, the officer should be above reproach at all times. If they act honestly, then a secret recording shouldn't matter. I'd hope that all officers should act like they are on camera at all times, don't you think?

Well I can't say I disagree with you Steve. I'm not a big fan of the way the law in Oregon is either. Unfortunately, it's what we all have to live with here. And yes, I have to inform people I am recording if I am recording audio. That goes both ways. Generally speaking citizens nor police have to notify for video. And it's not a permission thing. Consent is not required, you just have to inform.
I agree that some officers can be major pricks. Trust me I work with a couple. My whole point is that if the officer is being a jerk and you're breaking the law to prove something that his employer can't legally use agasint him, who wins? No one. The officer gets away with being a jerk and you end up in legal trouble. As for the appeals process, this issue has been appealed to the Oregon Supreme Court and the United States Supreme Court many times and the courts seem to find the law in compliance with the 4th Amendment and Article 1 Section 9 of the Oregon Constitution. The best way to change the law is for the legislature to change it. Since it was updated and made more restrictive in 2007 I doubt that's gonna happen anytime soon. If you really want to make a "secret" recording the best bet (in Oregon) is to call someone on the phone when you get stopped, put it on speaker phone and have that person record the call. Totally legal and now you have a witness too. But again, I caution anyone on this to consult your state's law. In reality any good cop should expect to be (and act like) they are being recorded at all times. I can't tell you how many times video/audio has saved my ass from BS complaints. Psersonally I wouldn't want to work without a video cam in my car. But, then again, I wouldn't pull over my gf's ex either. (That would totally piss off my wife. )

DriverRich...do you look at the Northwest section of these boards much? Seeing that you are in Oregon, you might even be interested in the Route 20 cruise I'm semi-organizing. You'd probably need to drive up Friday night to Bellingham, but it'd be cool to have yet another 2010 Camaro join on the drive across the mountains to Winthrop!

I had a cop (detective) who was my next door neighbor and he was one of those POWER cops. He kept harrassing me and long story short, I got him suspended for two weeks, he had to change shifts he was working and had to run with a partner for a while. They're not invincible. If he is harrassing you, gain evidence and then go after him. Also, if it's your word against his and like what was already said, he'll win that one, make sure you have witnesses. Even if he is a cop, you'll have three people's word against one.
