I had a 93 firebird V6 and the transmission was leaking. It took the dealer over 3 times for them to try and fix it. After going to another dealer and on the 4th attempt the new dealer replaced it. The car also was out of service for more than 30days, including other minor repairs (leaking t-tops etc...). After filing for lemon law (I asked for a refund and not a comparable car), GM agreed to take back the 94 and give me the same car, but a 96, and we agreed that I would pay the difference/increase in invoice between the two years. It was worth it.

You may file for lemon law under either NY or NJ. Since you live in NY I would apply in New York. NJ's threshold is harder to overcome become you must send a certified letter to the manufacture prior to the repair being completed. Also, if the repair was completed you may not qualify, I think the defect must still exist.

Under NY law, if the car was out of service for a total of 30 calendar days or more, even for the same repair and even if the repair was completed, you may qualify so long as the manufacture does not try to rebut and state that longer than 30 days for this type of repair is reasonable. Also, you could probably argue that the repaired engine substantially devalues the car.

It was not a car problem but aftermarket stuff, but it still sucks.

But like the Evil Twin said, easy fix. Pain in the ass, but easy fix. And no cost to you. Done in a day. So I'd go ahead and throw those mods on there and enjoy.

Im going to get the lawyers figure everything out. Apparently NJ is actually easier but again they will take care of everything.

I'll update when I know whats up.

So you are going to lemon law the car? Do you want out of this car now?

Sounds like you don't want the car anymore.

Maybe just document the troubles and give it one more chance?

I get the frustration. I've had my share for sure but I'm glad I stuck with it and allowed the companies to take care of them. I think you'd enjoy the car if you kept it. Let the dealer know your thoughts and maybe a letter from your lawyer and they may kiss your ass for a while. Tell them you want the engine bay, underside clean and no more problems.

Well, I don't see a need for a letter from the lawyer to the dealer. They are fixing it under warranty and I'm not aware that they have given him any crap over this current issue. I would think a letter from the lawyer would be going to GM to lemon law this car. That is all I can think. I don't see any other reason to get a lawyer involved.

I felt that way when the dealer (Depaula) splooged clear coat all over my car and it felt like sand paper paint! Its good now thanks to a REAL body guy who took care of it like it was his own...to the tune of $400 bucks at my expense. Maybe you can try another dealer/ mechanic who really is into the cars and will care for it better.

You may find you love your car again.....I did.
Either way, good luck to you.

Point is Id be pretty pissed if I didnt have my car for 44 days and then had something go wrong no matter now minor.
